Agreement to these terms

These Terms of Service are an agreement between you and TODO Legal Entity Ltd. ("we", "us"), the operator of Testy at testy-me.com (the "Service"). By using the Service — taking a test, giving us your email, or buying a subscription — you agree to these terms.

Two other documents form part of this agreement and you should read them: Subscription & Cancellation, which governs money, and the Privacy Policy, which governs your data. Where this document and the Subscription & Cancellation Policy differ on anything about billing, the Subscription & Cancellation Policy wins.

What we provide

Testy provides self-assessment tests and written reports about your own values and preferences. The free portion of a test gives you a summary of your result. A paid subscription unlocks the full report and the other tests and materials in the library.

We describe the Service as it exists today. We add, change and retire tests and reports over time. If we remove something you paid for and cannot replace it with something equivalent, tell us and we will refund the affected period.

Who can use it

• You must be at least 16 to take a test.
• You must be at least 18 and legally able to enter a contract to buy a subscription.
• The Service is directed at people in the United States. We do not knowingly market it to children under 13, and we do not knowingly collect their personal information.

If you are a parent or guardian and believe a child under 13 has given us information, email [email protected] and we will delete it.

Your email and account

We identify you by the email address you give us. Keep it accurate — it is where your result, your receipts, your renewal notices and your cancellation confirmation go. If you lose access to that address, contact us and we will verify you another way before making changes.

You are responsible for what happens through your email address and subscription. Do not share access to a paid subscription with people outside your household.

Subscriptions and payment

Subscriptions renew automatically until you cancel. The amount, the interval, the first renewal day and the cancellation steps are stated in full on the Subscription & Cancellation Policy, and the same figures are shown next to the button before you pay. As an example of the shape of it: the 7-Day Full Access charges $1.95 today, then $29.95 every 4 weeks starting on day 7, until you cancel.

Payment is taken by our payment processor. We never see or store your full card number. You confirm that you are authorised to use the payment method you enter, and that the billing details you give us are accurate.

Not professional advice

This one is important enough to repeat in three places. Our tests and reports are educational and entertainment content. They are not a psychological assessment, a diagnosis, a medical or mental-health service, legal advice, financial advice, or political advice. They do not tell you how to vote and they are not affiliated with, endorsed by, or produced in cooperation with any political party, candidate, campaign, committee or elected official.

Do not use a result as a reason to start, stop or change treatment, and do not use it to make an employment, lending, housing, insurance, educational or legal decision about anyone, including yourself. Full detail is in the Content Disclaimer.

Acceptable use

Do not:

• Scrape, bulk-download, resell, sublicense or republish our questions, reports or other content.
• Use the Service to screen, evaluate, rank or profile other people — applicants, employees, students, tenants or anyone else.
• Attempt to break, overload, probe or gain unauthorised access to the Service or anyone's data.
• Use automated systems to submit answers, create accounts or generate results.
• Remove attribution, or present our material as your own or as someone else's.
• Use the Service for anything unlawful, or to harass anyone.

Our content

The tests, question sets, scoring models, report text, design, code and brand are ours or our licensors'. Your subscription buys you a personal, non-exclusive, non-transferable right to read and use your own reports for your own purposes for as long as your subscription is active. It does not transfer ownership of anything.

You may share your own result — a screenshot, a link, a quote — for personal, non-commercial purposes. You may not republish the underlying questions or the full report text.

Your answers

Your answers are yours. You give us permission to process them in order to produce your result, run the Service, and — in aggregated, de-identified form that cannot reasonably be linked back to you — to improve our scoring models and to publish statistics about how people in general answer.

We do not sell your answers. We do not share individual answers with advertisers. What we collect and who receives it is set out in the Privacy Policy.

Availability and changes

We aim to keep the Service available but we do not promise it will be uninterrupted or error-free. We may change, suspend or discontinue parts of it. If a change materially reduces what you paid for, contact us and we will refund the affected period.

Suspension and termination

You can stop using the Service at any time, and cancel a subscription at any time. We may suspend or terminate access if you breach these terms — in particular the acceptable use section — or if we are required to by law. If we terminate your access and you have not breached these terms, we refund the unused part of your current period.

Disclaimers

To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that any result is accurate, complete, or suitable for any particular purpose.

Some states do not allow the exclusion of certain warranties, so parts of this section may not apply to you.

Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising out of or relating to your use of the Service.

Our total liability for all claims relating to the Service is limited to the greater of (a) the amount you paid us in the twelve months before the event giving rise to the claim, or (b) $50.00.

Nothing in these terms limits liability that cannot be limited by law, including liability for fraud. Some states do not allow certain limitations, so parts of this section may not apply to you.

Indemnity

You agree to indemnify and hold us harmless from claims, losses and reasonable legal costs arising from your breach of these terms or your misuse of the Service — for example, using a result to make a decision about another person contrary to the acceptable use section.

Governing law and disputes

Talk to us first. Almost everything is solved by an email. Before starting any formal proceeding, send a description of the problem and what you want to [email protected] and give us 30 days to fix it. If the issue is a charge you do not recognise, contacting us is faster than a bank dispute and usually resolves the same day.

These terms are governed by the laws of the jurisdiction in which TODO Legal Entity Ltd. is registered, without regard to conflict-of-law rules, and the courts of that jurisdiction have exclusive jurisdiction over disputes arising from them. Nothing here removes any right you have to bring a claim in your local small-claims court, or to complain to a consumer protection authority.

Changes to these terms

We may update these terms. The date at the top of this page always shows the current version. If a change materially affects your rights or what you pay, we email the address on your account at least 30 days beforehand. Continuing to use the Service after a change takes effect means you accept it; if you do not, cancel before then and the old terms apply to the period you already paid for.
